Welcome to Vitatrellis! These Terms and Conditions ("Terms") govern your use of the Vitatrellis mobile application (iOS and Android), web application, and related services (collectively, the "Service"). By accessing or using Vitatrellis, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, downloading the mobile app, or accessing the web application, you confirm that:
- You are at least 13 years old
- You have the legal capacity to enter into a binding agreement
- You have read, understood, and agree to these Terms
- You agree to comply with all applicable laws and regulations
2. Description of Service
Vitatrellis provides a platform to manage your daily tasks, shopping lists, recipes, and household activities. The Service is available through:
- Mobile Application: Available on iOS (App Store) and Android (Google Play)
- Web Application: Accessible through supported web browsers
- Backend Services: Cloud-based infrastructure for data synchronization
2.1 Core Features
- Task management with reminders and recurring tasks
- Shopping list creation and sharing
- Recipe collection and meal planning
- Household collaboration with multiple members
- Location tagging for tasks (foreground only)
- Data synchronization across devices
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Service, you must create an account. You can register using:
- Email and Password: Provide a valid email address, your name, and a secure password
- Google Sign-In: Use your existing Google account for quick registration
- Sign in with Apple: Use your Apple ID for secure authentication
- Facebook Login: Use your Facebook account to create an account
When using social login, we only request the minimum necessary information (email and name) to create your account.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using a strong, unique password
⚠️ Important: Never share your password with anyone. Vitatrellis staff will never ask for your password.
3.3 Account Termination
You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Shared Households
📢 Important Notice: By joining or creating a household, you acknowledge that certain data will be visible to other members of that household.
4.1 Household Data Sharing
When you create or join a household, the following data is shared with all household members:
- Tasks marked as "shared with household"
- Shopping lists created within the household
- Recipes added to the household collection
- Your name and basic profile information
4.2 Household Responsibilities
As a household member, you agree to:
- Respect the privacy and data of other household members
- Not share household data with non-members without consent
- Use shared features responsibly and appropriately
- Communicate with household members about data sharing preferences
4.3 Leaving a Household
You may leave a household at any time. If you are the last member of a household, all household data will be permanently deleted.
5. Subscriptions and Payments
5.1 Subscription Plans
Vitatrellis offers both free and paid subscription tiers. Paid subscriptions provide additional features such as:
- Unlimited tasks and recipes
- Advanced household features
- Priority support
- Ad-free experience
5.2 Payment Processing
All paid subscriptions are handled through third-party payment platforms:
- iOS: Apple App Store (Apple In-App Purchase)
- Android: Google Play (Google Play Billing)
- Web: May use Stripe or other payment processors
Payment Terms: Vitatrellis does NOT store your credit card information. All payment data is processed securely by Apple, Google, or our authorized payment processors.
5.3 Cancellations and Refunds
Cancellations and refunds for mobile app subscriptions are subject to the respective platform policies:
- Apple App Store: Governed by Apple's Standard EULA
- Google Play: Governed by Google Play Terms of Service
To cancel or request a refund:
- iOS: Manage subscriptions through your Apple ID settings
- Android: Manage subscriptions through Google Play Store
- Web: Contact support@vitatrellis.com
5.4 Automatic Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged through your Apple ID or Google Play account.
6. Acceptable Use Policy
⚠️ You agree NOT to use Vitatrellis for any illegal purposes or to store offensive content.
6.1 Prohibited Activities
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Store or share offensive, abusive, or harmful content
- Harass, threaten, or harm other users
- Upload malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service or other accounts
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems (bots) to access the Service
- Scrape or extract data from the Service without authorization
- Impersonate another person or entity
- Violate any applicable laws or regulations
6.2 Content Standards
All user-generated content (tasks, recipes, notes) must:
- Comply with applicable laws
- Not infringe on intellectual property rights
- Not contain hate speech, discrimination, or violent content
- Not contain personal information of others without consent
6.3 Enforcement
We reserve the right to:
- Remove content that violates these Terms
- Suspend or terminate accounts that violate the Acceptable Use Policy
- Report illegal activities to law enforcement
- Take legal action against violators
7. Disclaimer and Limitation of Liability
7.1 "As Is" Service
Disclaimer: Vitatrellis is provided "as is" and "as available" without any warranties of any kind, either express or implied.
While we strive for 100% uptime and data accuracy, we make no guarantees regarding:
- Service availability or uptime
- Accuracy or reliability of data
- Error-free operation
- Delivery of notifications or reminders
- Compatibility with all devices or browsers
7.2 Limitation of Liability
We are NOT liable for:
- Loss of data, tasks, or other content
- Missed tasks, reminders, or appointments
- Service interruptions or downtime
- Data synchronization issues
- Third-party service failures (Apple, Google, AWS, Cloudflare)
- Unauthorized access to your account due to weak passwords
- Consequences of actions taken based on app data
- Indirect, incidental, special, or consequential damages
7.3 Data Backup Responsibility
While we implement regular backups, you are responsible for maintaining your own backups of important data. Use the data export feature regularly.
7.4 Maximum Liability
In no event shall our total liability exceed the amount you paid for the Service in the 12 months preceding the claim.
8. Intellectual Property
8.1 Our Rights
The Service, including all content, features, and functionality, is owned by Vitatrellis and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Rights
You retain ownership of the content you create (tasks, recipes, notes). By using the Service, you grant us a license to:
- Store and process your content
- Display your content within the Service
- Share your content with household members as directed by you
8.3 Trademarks
"Vitatrellis" and associated logos are trademarks of Vitatrellis. You may not use our trademarks without prior written permission.
9. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains:
- What data we collect
- How we use and protect your data
- Your rights under GDPR
- Data storage in Europe (AWS EU region)
- Third-party services (Google AdMob, Apple/Google payments)
By using the Service, you also agree to our Privacy Policy.
10. Mobile Application Specific Terms
10.1 App Store Terms
If you download our app from the Apple App Store or Google Play, you also agree to their respective terms:
10.2 Location Services
The mobile app may request access to your device's location to enable location-based features. Location access is:
- Optional: You can deny location permission
- Foreground only: We do NOT track location in the background
- User-controlled: You can disable location access in device settings
10.3 Push Notifications
We use Firebase Cloud Messaging (FCM) to deliver push notifications to your device. By using the Service, you agree to receive push notifications for:
10.3.1 Service Messages (Mandatory)
- Security alerts and account notifications
- Household invitations and membership changes
- Important service updates and maintenance notices
- Subscription and payment confirmations
These notifications are essential for the proper functioning of the app and cannot be disabled. They ensure you receive critical information about your account and household.
10.3.2 Task and Reminder Notifications (Optional)
- Task reminders based on time or location
- Shopping list updates and reminders
- Household activity notifications
- Recipe meal planning reminders
These notifications enhance your experience but are optional. You can enable or disable them at any time in:
- App Profile settings
- Device notification settings (iOS Settings or Android Settings)
10.3.3 Marketing Communications (Opt-in Required)
- New feature announcements
- Tips and best practices
- Special offers and promotions
Marketing notifications require explicit consent and will only be sent if you opt in. You can opt out at any time through:
- App settings
- The unsubscribe link in any marketing notification
- Contacting support@vitatrellis.com
We respect your communication preferences and make it easy to control what notifications you receive.
10.4 Updates
We may release updates to improve the app. Some updates may be required for continued use of the Service.
11. Third-Party Services
The Service integrates with third-party services to provide functionality:
11.1 Firebase Cloud Messaging (FCM)
- Operated by Google LLC
- Used to deliver push notifications
- Collects device tokens for notification routing
- Governed by Firebase Privacy Policy
11.2 Social Authentication Providers
- Google Sign-In: Governed by Google Privacy Policy
- Sign in with Apple: Governed by Apple Privacy Policy
- Facebook Login: Governed by Facebook Privacy Policy
When you use social login, you agree to the terms and privacy policies of the respective provider.
11.3 Other Services
- Google AdMob: For advertising (free tier)
- Apple/Google Services: For app distribution and in-app purchases
- Cloudflare R2: For file storage
- AWS: For hosting and data storage (EU region)
These services have their own terms and privacy policies. We are not responsible for their practices.
12. Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by:
- Posting the new Terms in the app
- Sending an email notification
- Displaying a notice on our website
Your continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Termination
13.1 By You
You may stop using the Service and delete your account at any time through the app settings.
13.2 By Us
We may suspend or terminate your access to the Service if:
- You violate these Terms
- Your account has been inactive for an extended period
- We are required to do so by law
- We discontinue the Service
13.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Your data may be deleted according to our data retention policy
- Paid subscriptions will not be refunded (except as required by law)
14. Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of Denmark and the European Union, without regard to conflict of law principles.
14.2 Dispute Resolution
In the event of a dispute, we encourage you to first contact us at support@vitatrellis.com to seek an informal resolution.
14.3 Jurisdiction
Any legal action arising from these Terms shall be brought in the courts of Denmark.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vitatrellis.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
